Despite popular belief there is no legal requirement for an employment contract to be in writing and to be signed for it to be binding on both the employer and employee. Employers’ should, however, be aware that they must give each employee a written statement of the particulars of employment within 8 weeks of an employee starting employment. (Section 1 Employment rights Act 1998).

 

The Northern Ireland Industrial Tribunal has held that reducing an employees’ number of days holiday entitlement due to paying double pay for bank holiday’s is unlawful under the Working Time Regulations (Northern Ireland) 1998.

 

Many employers have been in the situation where a reference request lands on their desk, or the telephone rings and a reference is being sought in regards to a former employer. Perhaps you didn't rate, didn't trust or simply didn't like employee and you either do not want to provide a reference or you would like to give a poor reference. From today, April 6th 2012, any employees will have to have two years continuous employment before they can claim unfair dismissal. The change will not affect employees taken on before April 6th or those who make claims of unfair dismissal for asserting their employment rights.
